Terms of Service
These terms govern use of MyShopStreet. The plain-language buyer protection process is explained on the Trust & Safety page.
Effective September 30, 2026
Eligibility
MyShopStreet is for adults. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to create an account, list items, or make purchases. By using MyShopStreet you represent that you meet this requirement. Accounts found to be held by someone underage may be restricted or closed, and any held funds will be handled according to our payments terms and applicable law. Sellers are responsible for complying with the age-restriction laws that apply to what they sell.
Marketplace role
MyShopStreet provides marketplace software, payment coordination, communication tools, and order support. Independent sellers are responsible for the accuracy, legality, safety, authenticity, packaging, and fulfillment of their listings.
Payments and seller proceeds
Buyers pay MyShopStreet through our payment processor. Seller proceeds are held and are not released before fulfillment. For shipped orders, proceeds are released when the buyer confirms receipt, or automatically after carrier-verified delivery on the seller's tier schedule: New sellers 7 days, Trusted sellers 3 days, Power sellers 24 hours after the delivery scan. For shipments without carrier-verified tracking, delivery is estimated at 7 days after shipment and the buyer has 3 days after that to open a dispute; if none is opened, proceeds release 10 days after shipment. An open dispute, cancellation, or refund freezes release until resolved. Verified in-person handoff releases proceeds when the buyer’s handoff code is accepted.
Shipping advances
When a buyer pays for shipping at checkout, MyShopStreet transfers that shipping amount to the seller's connected payout account shortly after the sale completes (the “shipping advance”), so the seller can purchase the shipping label without fronting the cost. The advance is label funds only: it is not part of seller proceeds, does not reduce the platform's commission, and is sent separately from the scheduled proceeds release. If the order is cancelled or refunded, the advance is reversed before any buyer refund is issued. Sellers with no completed sales do not receive the advance until after their first completed sale. Shipping labels are purchased through the seller's own shipping account and charged to the seller; the seller is solely responsible for all label costs, including labels for orders with free shipping. MyShopStreet never pays for shipping labels.
Refunds, disputes, and chargebacks
Eligible refunds and chargebacks are taken from funds still held for the order. If proceeds have already been released, additional recovery rights and obligations may apply. Buyers must report order problems promptly and provide accurate supporting information. Fraudulent claims or payment disputes may result in account restrictions.
Fees
The checkout total shows all buyer charges before payment. The Safe Street Guarantee fee is 4% of the item subtotal, with a $0.90 minimum. The 10% commission (plus any optional boost fee and seller-covered label share) is deducted from seller proceeds; MyShopStreet absorbs card-processing costs. Listing is free — there are no listing fees. The first 20 shops to open on MyShopStreet are Founding Shops: their commission is 5% instead of 10%, for the life of the shop, with no time limit and no order limit. Applicable fees may be non-refundable where permitted by law.
Taxes
Sellers are independent sellers, not employees or agents of MyShopStreet. You are responsible for reporting your sales and paying any income, sales, or other taxes you owe on them. MyShopStreet reports seller earnings to tax authorities as required by law, including issuing IRS Form 1099-K when you meet the reporting threshold for the calendar year. This section is not tax advice — consult a tax professional about your obligations.
Product and handoff risk
MyShopStreet does not manufacture, store, inspect, or ship listed goods. Buyers should review listings carefully. People arranging an in-person handoff should meet in a public place, inspect the item before sharing the handoff code, and follow local safety guidance.
Disclaimers
To the fullest extent permitted by law, MyShopStreet disclaims implied warranties regarding listings, users, carrier performance, third-party services, and uninterrupted platform availability. Nothing in these terms excludes rights or remedies that cannot legally be excluded.
Limitation of liability
To the fullest extent permitted by law, MyShopStreet is not liable for indirect, incidental, special, consequential, or punitive damages. MyShopStreet’s aggregate liability for a claim is limited to the platform fees paid by the claimant during the twelve months before the event giving rise to the claim, except where a different limit is required by law.
Indemnification
You agree to defend and indemnify MyShopStreet and its operators against third-party claims, losses, and reasonable costs arising from your listings, content, unlawful conduct, breach of these terms, or misuse of the service, to the extent permitted by law.
Account enforcement
Off-platform payment requests, counterfeit goods, misleading listings, harassment, fraud, or attempts to evade marketplace safeguards may lead to listing removal, payment holds, account restrictions, or suspension.
